1. DMCA Notice & Copyright Policy

Kaboons (https://kaboons.com) respects the intellectual property rights of others and expects our users and partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512, "DMCA"), we will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent.

This policy sets forth the required procedures for submitting a formal DMCA Takedown Notice to request the removal of alleged infringing content, as well as the process for submitting a Counter-Notification.

2. How to File a DMCA Takedown Notice

If you are a copyright owner, or authorized to act on behalf of one, and you believe that any material or content hosted on our website infringes upon your copyright, please send a written notification to our Designated Agent containing the following elements:

1. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the exact URL(s) or link(s) to the material on our website.
4. Contact Information: Information reasonably sufficient to permit us to contact you, including your full legal name, physical address, telephone number, and email address.
5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedure

If material that you posted on our website has been removed or disabled as a result of a DMCA notice, and you believe that the material was removed by mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent.

To be effective, your Counter-Notification must include:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your full legal name, physical address, phone number, and email address.
• A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the United States District Court for Wisconsin if outside the U.S.), and that you will accept service of process from the person who submitted the original DMCA notice.

4. Processing & Repeat Infringers

Upon receipt of a valid DMCA Takedown Notice, Kaboons will take swift action to remove or disable access to the allegedly infringing material and notify the affected party. If a valid Counter-Notification is received, we will forward it to the original complaining party.
